This Legal Manager position plays a crucial role for this aquaculture subsidiary in a big holding company, especially when it comes to acquiring and securing land for their operations. Other than land acquisitions, they are expected to do general corporate matters, with sound business acumen.

Description

• Conducting thorough research on the relevant laws and regulations governing land acquisition and aquaculture in the specific jurisdiction. This includes understanding zoning laws, environmental regulations, permits, and licenses required for aquaculture operations
• Conducting thorough research and investigations to evaluate the legal status of the land to be acquired, including verifying ownership, encumbrances, liens, and any legal disputes or claims associated with the property
• Ensuring compliance with all relevant laws and regulations pertaining to land acquisition in Indonesia, including but not limited to the Agrarian Law, Spatial Planning Law, and Land and Building Tax Law
• Preparing and reviewing legal documents such as sale and purchase agreements, lease agreements, land use agreements, and other contracts necessary for the land acquisition process. Negotiating terms and conditions on behalf of clients to protect their interest
• Assisting the company in obtaining the necessary permits and licenses required for land acquisition and business purposes. This may include permits such as the Principal Business License (Izin Usaha Utama), Building Permit (Izin Mendirikan Bangunan), and other specific permits related to the intended business activity
• Facilitating the transfer of land ownership through proper legal procedures, including the execution of deeds, registration of the transaction with the National Land Agency (Badan Pertanahan Nasional/BPN), and ensuring that the client’s ownership rights are adequately protected
• Representing clients in negotiations, mediations, or litigation processes in the event of land-related disputes, such as boundary disputes, conflicting claims, or disagreements over compensation.

Profile

• Bachelor of Law, with minimum of 8 PQE
• Excellent English command, written and oral (English-speaking reporting line)
• Strong knowledge and expertise in Indonesian land acquisition laws and regulations, with a focus on agrarian law, spatial planning law, and environmental regulations related to aquaculture activities. Familiarity with specific laws and regulations governing the aquaculture industry would be highly beneficial
• Demonstrated experience in handling land acquisition cases, preferably in the context of aquaculture or related industries. Experience in conducting legal due diligence, negotiating contracts, and resolving land-related disputes would be valuable
• In-depth understanding of the specific permits and licenses required for establishing and operating aquaculture facilities in Indonesia. Familiarity with the permit application process, documentation requirements, and relevant government agencies involved in issuing permits for aquaculture operations
• Understanding of the commercial aspects of aquaculture operations, including the ability to assess the feasibility of land acquisition projects from a business perspective. Knowledge of the aquaculture industry, market trends, and potential risks or challenges involved in acquiring land for aquaculture purposes
• Strong negotiation skills to effectively represent the company’s interests in land acquisition negotiations
• Excellent communication skills to interact with stakeholders, government officials, landowners, and other parties involved in the process. The ability to convey complex legal concepts in a clear and concise manner is essential
• Meticulous attention to detail in conducting legal research, reviewing contracts, and preparing documentation related to land acquisition. Thoroughness in identifying and resolving potential legal issues or risks associated with the land acquisition process
• Strong analytical skills to assess complex legal situations, identify potential challenges, and develop effective strategies to overcome them. The ability to think critically and provide innovative solutions to land-related issues or disputes.
