As a Contract & Claims Manager for Process Automation business, you will be responsible for leading the provision of contract management services, ensuring all contract management activities are executed in accordance with the relevant group/division/business directives and instructions including company procedures and the contract management framework. Reporting to Hub Division Controller, you will be ensuring the portfolio of contracts in the business, follows contract and claim management methodologies in accordance with internal standard procedures. This position is based in Jakarta, Indonesia.

Your responsibilities

Reviewing and commenting on commercial and technical tender terms and conditions

Liaising with the relevant sales/tendering team and legal counsel to develop contract and negotiation strategy based on ABB’s policies, customer requirements, and the overall execution strategy taking into account risk, pricing, scope, and schedule and ensuring that all necessary approvals related to terms and conditions are complied with

Identifying the contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule and other documents incorporated in the contract) and highlights areas of potential risk

Assisting the relevant Project Manager in implementing the appropriate contract administration, to ensure timely and accurate execution of commercial aspects in portfolio contracts as well as regular participation in project reviews

Verifying that both parties to the contract have fulfilled their contractual obligations and there are no responsibilities outstanding

Establishing and enforcing standard change methodologies in portfolio of contracts to identify changes and quantify the additional time and compensation due to ABB per the contract, defines approval requirements and communicating changes to the customer

Assisting the Project Manager in enforcing and defending ABB’s contractual interest against customers and suppliers during the lifecycle of the project

Notifying of any major claims and disputes or potential litigation and cooperate with legal counsel in developing appropriate claims/dispute resolution strategy

Assisting in any negotiation of terms and conditions both at tender stage or during the lifecycle of the project

Supporting drafting of purchase orders, contracts and subcontracts and ensuring that relevant (sub) contracts contain appropriate contract terms to protect ABB’s interest, including flow-down of main contract terms

Analyzing contract terms to highlight areas of potential opportunity and risk, such as ambiguities, omissions and conflicts, as work proceeds

Ensuring contract insurance provisions are adhered to and coordinating with insurance risk management regarding occurrences that may be covered by customer or ABB provided insurance

Liaising and cooperating with other relevant functions i.e. legal, finance, tax, trade compliance, etc. to ensure that the area of responsibility is performed appropriately

Your background

Bachelor degree in Law or relevant field with at least 10 years of experience in contract & claims management for large projects (i.e. EPCs)

Possess strong contract drafting and negotiation skills

Familiar with well-known international standard contracts for large projects i.e. FIDIC terms and conditions

A strong focus on safe work practices and dedication to following all relevant workplace safety guidelines

A collaborative, solution-focused and attention to detail approach and strong written and spoken communication skills
